The Industry Debate: Independent Contractors vs. Employees

In the ongoing debate about the classification of temporary nursing staff, David Savitsky, CEO of ATC Healthcare Services, offers a clear stance. The controversy centers on whether these professionals should be considered independent contractors or employees, a topic that has stirred significant discussion within the healthcare staffing industry.

"Nurses working through staffing firms as W-2 employees have the same rights to turn down assignments or ask for higher pay," Savitsky points out.

Savitsky, a seasoned executive in healthcare staffing, firmly believes that temporary nursing staff should not be classified as independent contractors. He argues that there is no substantial difference between the roles filled by temporary nurses through traditional medical staffing companies and those proposed to be classified as independent contractors.

"They really aren’t independent contractors, and they just don’t meet the standard," Savitsky asserts. "This to me is just a stretch, a big stretch."

Savitsky highlights the practical aspects of this classification. Staffing firms provide essential support such as insurance, workers' compensation, disability insurance, and professional liability insurance. These are critical in hospital settings, where injuries like needle sticks, back injuries, and slips and falls are common.

In contrast, independent contractor nurses would need to secure their own coverage and handle their taxes, which, according to Savitsky, does not align with the nature of their work.

Owner of ATC Healthcare Services - Youngstown, Gina McLaughlin, started her office alone as NurseCall Inc. in 2003. She hired 5 RN friends, including herself, and secured local contracts from four hospital systems in her hometown. At the time, she was already an agency nurse working through another agency. 

Due to the incredible work Gina was doing in Youngstown, ATC Healthcare Services President, Stephen Savitsky, called her and offered to fly her to New York, and have her become a strategic partner of ATC Healthcare Services. The rest is history!

When she came on board with David and Steve, she was billing $450,000/year. Last year, she billed $5,200,000 and has a goal of doubling it.  

ATC Youngstown Celebrates 20 Years in Business

Being a single mom, Gina needed to find a way to make a living. She was a traveling nurse for 15 years, so she knew that she could succeed in this industry. She chose her territory because she had already made relationships with the hospital systems in her hometown. The close proximity of Cleveland and Akron also made it an ideal location with a lot of opportunities.

ATC Healthcare Services - Youngtown maintains a local presence in its community. This, paired with the ability to network and find power partners, has allowed them to facilitate business opportunities for one another. She also donates annually to a non-profit organization in our community on behalf of ATC Healthcare Services and Carebuilders at Home, ATC’s homecare sister franchise.

This 20-year celebration was a true celebration of success. Gina states, “I could not have achieved this without family, friends, and colleagues. Together, as a community, we made relationships with so many people who have been there for my office, and I have been there for them. My office team is great! They love what they do, and our success is a result of their efforts. I’ve learned over time, find the right people, give them the tools to be successful and they will be!”

Born and raised in North Shreveport, Louisiana, she has created quite a mark in her hometown. Being Northwood High School’s first African American Homecoming Queen in school history, then the first female student-athlete to receive a full basketball scholarship to a Division I University, and is a part of her high school’s Hall of Fame sports history. Tina now owns and operates the ATC Healthcare Services - Spring office by providing healthcare facilities with the qualified staff they need to help their patients.
